H-1B Electronic Registration Process Begins for the Fiscal Year 2021

USCIS announced several important details regarding FY 2021 H-1B Cap Season Electronic Registration Procedures in Federal Register on 01/09/2020 and in its official website on 02/12/2020

According to the announcements, the employers seeking to benefit from the foreign workforce within the FY 2021 H1-B Visa provision will be able to submit their initial registrations from February 24 through March 20, 2020. In the course of this initial period, those concerned prospective employers are expected to submit their online registrations specifying the names of each foreign worker they intend to file an FY 2021 cap-subject petition. Of course, they must pay the required non-refundable $10 registration fee per the submission.

Subsequent to the closure of the initial period, if the adequate number of registrations are collected, USCIS will conduct a lottery and select the number registrations as much as the pre-determined number of allocations for FY 2021. Selected registrants will be notified on or before March 31, 2020. Please keep in mind that qualified employers are allowed to file an H-1B FY 2021 cap-subject petition only for the employees they specified in their registrations during the initial period.

Prospective petitioners and their representatives can create their accounts by Feb. 24 and register throughout this period; selections will take place after the initial registration period closes, so there is no requirement to register on March 1.

H-1B Registration Process Timeline

Feb. 24: Prospective petitioners may begin creating H-1B registrant accounts. Representatives may create an account at any time.

March 1: H-1B registration period opens at noon ET.

March 20: H-1B registration period closes at noon ET.

March 31: Date by which USCIS intends to notify selected registrants.

April 1: The earliest date that FY 2021 H-1B cap-subject petitions may be filed.
